On 28 March 2023, the Ministry of Family and Social Policy presented a draft regulation on the employment certificate. The document will have to include information on the use of new types of leave and sick leave introduced by the amendment to the Labour Code. The draft regulation includes a new auxiliary template of the employment certificate in the content of the annex.
According to the new regulations, the employer will also include information in the employment certificate regarding:
- the employee’s use of a leave from work due to force majeure, used in the calendar year in which the employment relationship ended (in a given calendar year a maximum of 2 days or 16 hours),
- the employee’s use of carer’s leave taken in the calendar year in which the employment relationship ended (maximum 5 days per year),
- the number of days of occasional remote work in the calendar year in which the employment relationship ended (up to a maximum of 24 days per year).
The purpose of including this information in the employment certificate is to help the next employer who will employ him in the same calendar year in which the employment relationship with the previous employer ended.
